‘Boete voor AFP en Getty helpt bescherming auteursrecht niet vooruit’

Eind vorige week kwam de jury bij een rechtbank in New York tot een stevig oordeel: de persbureaus AFP en Getty moeten een schadevergoeding van 1,2 miljoen dollar betalen aan fotograaf Daniel Morel voor het ongeoorlofd gebruiken van acht foto’s die Morel twitterde van de aardbeving op Haïti in 2010. Blogger/fotostrateeg Paul Melcher vindt de uitspraak geen hulp voor het beschermen van het auteursrecht voor fotografen: Pinterest en duizenden andere websites zullen doorgaan met het ongevraagd gebruiken van foto’s.

Melcher schrijft op zijn blog Thoughts of a Bohemian onder meer: ‘Pinterest is not worried about this judgement, nor are thousands upon thousands of websites that continuously use photographs without proper approval. Flickr, or Tumblr – you pick- are currently hosting thousands, if not millions of illegal images. right now. ( including probably, ironically, Morel’s images). They don’t get caught, judged or punished. In fact, they are valued at billions of dollars. Do they do anything to educate or protect copyright? Nope. Nor do they care.’
